These Terms of Use (“Terms”) govern access to and use of txbusinessbrief.com and its pages, features, and services (the “Site”). By using the Site or affirmatively accepting these Terms when requested, you agree to them. If you do not agree, do not use the Site or complete the applicable transaction.

In these Terms, “Texas Business Brief,” “we,” “us,” and “our” refer to Texas Business Brief LLC, a Texas limited liability company and the publisher and operator of the Site. If you use the Site or submit materials for an organization, you represent that you have authority to act for and bind that organization.

1. Nature of the Publication

Texas Business Brief is a statewide business publication, including independent editorial and contributor content. Publication does not constitute endorsement or independent verification.

2. Publishing Services

We also provide paid writing, publishing, advertising, sponsorship, and marketing services. Payment does not guarantee publication of material that fails to meet our editorial standards or legal requirements. The applicable service agreement or order governs the specific deliverables, fees, publication period, cancellation rights, credits, and refunds.

3. Paid Content and Disclosures

Paid content will prominently display partner label and disclose financial support. Paid links will be identified to search engines as sponsored or nofollow links, as appropriate.

Political advertising.

Texas Business Brief does not accept political advertising or paid content that expressly advocates for or against a candidate, political party, or public officeholder.

4. Editorial Control and Standards

We may edit submissions for clarity, accuracy, readability, and editorial standards, or decline publication for editorial or legal reasons, even after payment. Contributors must approve articles we write or materially edit and remain responsible for factual accuracy and substantiation. We may require attribution, sourcing, or additional context for sensitive or contested material. We may correct, update, restrict, or remove material because of legal concerns, inaccuracies, rights complaints, or violations of these Terms. Any continued-placement, cancellation, replacement, credit, or refund obligation is governed by the applicable written service agreement and law.

Correction, clarification, or retraction requests.

Send a signed written request using the contact information in Section 15. Identify the requester, the challenged statement, its publication date and location if known, the alleged error or defamatory meaning, and the supporting basis. We may request additional information and will respond as required by applicable law. Contributors must cooperate promptly.

5. Acceptance and Changes to These Terms

We may revise these Terms prospectively by posting an updated version and Effective Date. We will provide prominent notice of material changes and obtain affirmative acceptance where required by law. Changes do not alter accrued rights or obligations. Separate service agreements remain governed by Section 14.

Eligibility and accounts.

You must be at least 18 to enter a transaction through the Site. The Site is not directed to children under 13.

Electronic acceptance.

Where we require affirmative acceptance, we may retain a record of the acceptance as permitted by law.

6. Use of the Site

You may view, download, and print individual Site pages for personal, noncommercial use if all proprietary notices remain intact. Without our prior written permission, you may not:

  • copy, republish, distribute, modify, or commercially exploit Site content;
  • scrape, systematically retrieve, or compile Site content, or use it to train, develop, fine-tune, or improve an artificial-intelligence or machine-learning model, except that public search engines may crawl and index the Site under our robots.txt instructions solely to display search results;
  • remove or obscure attribution, paid-content disclosures, or proprietary notices, or falsely suggest affiliation, sponsorship, or endorsement;
  • frame or mirror the Site, bypass restrictions, gain unauthorized access, introduce malicious code, or interfere with Site security or operation; or
  • use the Site or submit material in violation of law or another person's rights, including unlawful, defamatory, fraudulent, threatening, harassing, infringing, private, deceptive, spam, or malicious material.

7. Content You Submit

Ownership and license.

You retain ownership of content submitted for publication or promotion (“Submitted Content”). You grant Texas Business Brief a worldwide, royalty-free, nonexclusive, perpetual license to use, reproduce, edit, adapt, publish, display, distribute, promote, and archive Submitted Content in connection with the Site and our publishing and marketing business. The license includes use through service providers and promotional channels and may transfer with the related business. Submitted Content is not confidential unless we agree otherwise in writing.

The license covers names, logos, photographs, and identifying material only to the extent you have authority to license them. It survives for previously published content, subject to any removal or duration rights in a separate written agreement. It does not apply to information provided solely through a general inquiry or newsletter sign-up. To the extent permitted by law, you waive moral rights and similar rights for authorized uses.

Your responsibility.

You represent and warrant that you have all permissions, releases, and consents needed for Submitted Content and its authorized use, including copyright, trademark, privacy, and publicity rights. Claims must be accurate, not misleading, and appropriately substantiated. You must disclose material commercial relationships and promptly notify us of material errors or rights disputes. Our review or editing does not relieve you of responsibility for material you supply.

Testimonials, rankings, and regulated content.

Testimonials, reviews, and endorsements must reflect genuine opinions and actual experience, disclose material connections, and comply with applicable rules. Paid lists, rankings, awards, and recognitions will be labeled as paid advertising. Licensed professionals and persons promoting regulated products or services are responsible for all applicable advertising, disclosure, filing, recordkeeping, and approval requirements. We do not provide industry-specific compliance review.

General inquiries.

Information submitted through a general inquiry or newsletter form will be handled as described in our Privacy Policy. A general inquiry does not enroll you in marketing communications or authorize publication of your name or contact information. Do not submit Social Security numbers, payment-card details, passwords, or other sensitive information except through a secure channel specifically provided for that purpose.

8. Advertising and Sponsorships

Advertisers and sponsors are responsible for the accuracy, legality, and compliance of their materials and for their products, services, statements, and omissions. We may change or remove placements subject to applicable written commitments.

The applicable service agreement or order governs fees, taxes, payment deadlines, deliverables, publication periods, cancellation rights, and refunds. These Terms alone do not authorize recurring charges or automatic renewal. Unless expressly stated in a written agreement, we do not guarantee audience size, impressions, clicks, leads, sales, search-engine rankings, or other commercial results. An agency or representative placing an order must have authority to act for the advertiser.

9. Intellectual Property and Copyright Complaints

Site content, including text, images, graphics, logos, designs, software, data, and marks, belongs to Texas Business Brief, its licensors, or the applicable rights holders and is protected by intellectual-property laws. Except for the limited personal use permitted in Section 6, use of Site content or our names or marks requires prior written permission.

Our Privacy Policy, available at /privacy and incorporated by reference, describes our collection, use, disclosure, and protection of personal information, cookies and similar technologies, and applicable privacy rights and choices. Where law requires consent or an opportunity to opt out, we will provide that choice separately. Accepting these Terms is not consent to processing that requires separate consent.

Commercial emails will identify the sender and paid content, include a valid postal address and working unsubscribe link, and honor unsubscribe requests as required by law.

14. Governing Law and Other Terms

Governing law and venue.

Texas law governs these Terms without regard to conflict-of-laws principles. Each party consents to those courts' jurisdiction.

Business disputes.

For contributors, advertisers, sponsors, and other customers who affirmatively accept these Terms in a business capacity, the applicable written service agreement controls dispute resolution. If it is silent, disputes relating to services, submissions, or these Terms will be resolved by binding arbitration administered by the American Arbitration Association under its Commercial Arbitration Rules before one arbitrator in Kendall County, Texas. The Federal Arbitration Act governs. Either party may bring an eligible individual claim in justice court or seek temporary injunctive relief to protect intellectual property, confidential information, or the Site. Miscellaneous.

If a provision is unenforceable, the remainder remains effective. Failure to enforce a provision is not a waiver. Site use does not create a partnership, joint venture, employment, agency, or professional relationship. We may assign these Terms in connection with our business; you may not assign them without our written consent. Provisions that by their nature should survive termination will survive, including intellectual-property, license, accrued-obligation, disclaimer, liability, indemnification, and dispute provisions.
